Fortuito is committed to the safety and well-being of every member. This Safety Policy describes how we protect our community, what behavior is prohibited, how to report misconduct, and the resources available to you. This policy is published in compliance with Colorado Senate Bill 24-011.
1. Prohibited Content and Conduct
Fortuito prohibits all content and conduct that threatens public or personal safety, including but not limited to:
Misconduct That Threatens Safety
- Violence: Homicide, assault, battery, or any threat of physical harm
- Sexual misconduct: Unlawful sexual behavior, sexual assault, sexual coercion, or any non-consensual sexual contact
- Stalking and harassment: Stalking, harassment, intimidation, or any pattern of behavior intended to cause fear or distress
- Kidnapping or unlawful restraint
- Involuntary intoxication: Drugging or administering substances to another person without their knowledge or consent
- Theft, robbery, or financial fraud: Including romance scams, phishing, and financial exploitation
- Any other conduct that threatens public safety or another person's safety
Prohibited In-App Content and Behavior
- Hate speech, slurs, or discriminatory language targeting any individual or group based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic
- Sexually explicit, pornographic, or obscene messages or images
- Threats of violence or harm, whether direct or implied
- Bullying, intimidation, or abusive language
- Spam, solicitation, or commercial activity
- Impersonation or misrepresentation of identity
- Sharing another member's personal information without consent
- Any content that promotes illegal activity
Zero-Tolerance Policy: Fortuito maintains a zero-tolerance policy for misconduct that threatens personal or public safety. A single substantiated report of threatening behavior, sexual misconduct, or other safety-threatening conduct may result in immediate and permanent removal from the platform.
Notice Regarding Sexual Consent: Engaging in sexual conduct with another person without that person's consent violates this Safety Policy, is against the law, and may result in criminal or civil liability.
2. Criminal Background Screening
Fortuito does not conduct criminal background checks on members. Fortuito verifies members via phone number only and does not collect members' real names, government identification, or other identifying information sufficient to perform background screening.
Fortuito does not exclude members based on criminal history, as Fortuito does not have access to this information. Members should exercise their own judgment and take appropriate safety precautions when interacting with anyone they meet through the service.
3. Identity and Age Verification
Fortuito takes the following steps to verify member identity and age:
- Phone verification: Every member must verify their phone number via a one-time SMS passcode during registration. Each phone number may only be associated with one Fortuito account.
- Age verification: Members must enter their birthdate during profile setup. Members whose birthdate indicates they are under 18 years of age are blocked from using the service. Members whose birthdate indicates they are 18 or older must affirmatively attest that they are at least 18 years of age and that the birthdate they provided is accurate before they can proceed.
- Birthdate permanence: Once a member has confirmed their birthdate, it cannot be changed. Members who need to correct an error must contact Fortuito support.
Fortuito does not perform government ID verification or facial recognition. Fortuito does not use photos of any kind. Members are identified to each other by short codes, not by real names or photos.
4. Suspension and Barring of Members
Fortuito takes action against members who violate this Safety Policy or the Terms of Service. Actions may include:
Automatic Content Filtering
All messages sent through Fortuito are screened by an automated content filter. Messages containing slurs, threats, sexually explicit language, and other objectionable content are blocked before delivery. The sender is notified that their message was not sent and is asked to remove inappropriate language.
Report-Based Action
Fortuito reviews all member reports within 24 hours. Based on the severity and nature of the reported behavior, Fortuito may take the following actions:
- Warning: For first-time, lower-severity violations such as mildly inappropriate content
- Suspension: Temporary restriction of the member's ability to use the service
- Permanent barring: The member's account is permanently terminated and they are prevented from creating a new account with the same phone number
The following may result in immediate permanent barring without prior warning:
- Any report of threatening behavior or threats of violence
- Any report of sexual misconduct or sexual coercion
- Any report involving child safety concerns
- Any report of stalking, harassment, or intimidation
- Any report of criminal conduct facilitated through the service
Members who are barred are permanently prevented from being matched with any Fortuito member in the future.
5. Appeal Process
Fortuito does not currently offer an appeal process for members who have been suspended or barred as a result of reports of prohibited content and conduct.
6. Notification to Other Members
Fortuito does not notify other members who have had contact with a member who has been suspended or barred from the service.
Because Fortuito matches are anonymous — members are identified by short codes, not real names, and the service does not use photos — and because barred members are permanently prevented from being re-matched with any previous contacts, Fortuito has determined that such notifications would not provide actionable safety information to prior matches and could cause unnecessary alarm.
7. How to Report Prohibited Content and Conduct
If you experience or witness prohibited content or conduct, you can report it directly through the Fortuito app:
To report a member:
- On the Matches screen, tap the flag icon next to the member you want to report
- Select "Block & Report" from the dialog
- Choose a category that best describes the behavior (Harassment, Threatening Behavior, Inappropriate Content, Spam/Scam, Child Safety, Safety Concern, or Other)
- Provide details about what happened (optional but recommended)
- Check the box to include your message history as evidence (optional but recommended if the behavior occurred in chat)
- Tap "Block & Submit Report"
You will receive a reference number for your report. The reported member will be immediately blocked and removed from your matches.
You can also report issues through our website at fortuito.app/report.html or by emailing support@fortuito.app.
If you want to block a member without filing a formal report, tap the flag icon and select "Block" instead. This will permanently remove them from your matches and prevent future matching.
False Report Warning: Members must not submit false reports or reports motivated by malice, bias, or other illegitimate reasons. Submitting false reports is a violation of Fortuito's Terms of Service and may result in suspension or permanent barring of the reporting member's own account.
8. Platform Safety Measures
Fortuito has implemented the following safety measures to promote safer online and in-person dating experiences for members:
- Phone number verification via one-time SMS passcode for all accounts
- Age verification with under-18 lockout and explicit attestation for members 18 and older
- Mandatory community guidelines consent during onboarding — members must accept the Terms of Service, Community Guidelines, and this Safety Policy before using the app
- Safety education during the onboarding tutorial, including instruction on how to delete, block, and report matches
- Automated server-side content filtering on all messages, blocking slurs, threats, sexually explicit language, and other objectionable material before delivery
- Block mechanism allowing members to permanently remove and prevent re-matching with any other member at any time
- Block & Report mechanism allowing members to block a user and submit a detailed report with categorization, written description, and optional message history evidence
- 24-hour report review commitment — all reports are reviewed within 24 hours of submission
- Permanent barring and re-match prevention for members who violate this Safety Policy
- Anonymous matching — members are identified to each other by short codes, not real names or contact information, and the service does not use photos, until they choose to share personal details in conversation
- Automatic location data deletion — location data is deleted after 2 hours and is never shared with other members
- Privacy Zones — members can designate sensitive locations (such as home or workplace) where the app will not detect proximity or create matches. Privacy Zones are stored on-device only; Fortuito does not have access to your Privacy Zone locations
- Periodic location sharing reminders — users who have been sharing their location continuously receive a push notification reminding them that location sharing is active and how to adjust it
